Terms and Conditions
This policy concerns the General Terms and Conditions of Foraging Colours' practices related to its website. Foraging Colours respects your right to privacy and does not collect any personal information about you on this website without your consent. All personal data you provide will be handled with the security and confidentiality safeguards required by the Data Protection Law.
For the purposes of these Terms and Conditions, the following definitions apply: "FORAGING COLOURS" – the entity marketing the products on the website foragingcolours.com; "CLIENT" – the individual placing an order on the website foragingcolours.com for non-commercial purposes; the use of the foragingcolours.com website and the purchase of products implies the Client's knowledge, understanding, and acceptance of these General Terms and Conditions.
1. Website Registration
To place an order, registration is required by completing the form under "Order Details." Once registered on the website, you will not need to fill it in again, as your data will be stored automatically.
From the moment you register, you are accepting these Terms and Conditions.
2. Products and Services
The website foragingcolours.com is intended for all Clients wishing to purchase products for non-commercial purposes in Portugal and in European Union countries.
Foraging Colours reserves the right to change at any time and without prior notice the information, the range of products, experiences and services, prices, and the Terms and Conditions of sale on the foragingcolours.com website.
Although the photographs aim to represent the products as accurately as possible, they may not truly reflect their colours and materials due to photographic quality. For materials, it is important to consult the details of each product.
Foraging Colours items, particularly children's clothing, mostly come, with few exceptions, from second-hand sources, of good quality and selected in person, assessing the fibre quality and previous use.
NOTE: Foraging Colours products for sale use natural pigments derived from plants, rocks, and insects. Products using pigments derived from insects are marked as "Not vegan."
3. Quality
Foraging Colours does not sell counterfeit products, defective items, or products made with raw materials different from those described in the specifications of each product. The clothing items for sale have mostly been sourced from second-hand clothing stores.
Although Foraging Colours strives to represent its products and services as accurately as possible, please note that images may vary in colour and texture depending on photographic quality. Therefore, we always recommend consulting the details of each product.

4. Orders
To place an order on www.foragingcolours.com, an email address is required for registration. After registering, follow the steps to complete your purchase: find the product(s) you wish to buy and select them. Then, click on "Cart" at the top right of the website header and fill in the requested personal information about the Client. This information will be incorporated into Foraging Colours' database in accordance with the Privacy Policy, including first and last name, billing address, shipping address, email, phone number, payment method, and shipping method. Finally, review your order and confirm it.
After completing the purchase, the Client will receive an email regarding their order with the payment deadline.
Once payment is confirmed, Foraging Colours will begin the order dispatch process. The Client will receive an order confirmation email. After validating the payment, a confirmation email will be sent.
If the Client requires a receipt with a tax identification number (NIF), it must be requested via email at foragingcolours@gmail.com.
Your order will be delivered by the courier to the delivery address provided during the purchase process, along with the corresponding detailed invoice. By submitting the order form, you accept these Terms and Conditions, as well as the Privacy and Cookie Policies.
5. Prices
Foraging Colours reserves the right to change prices on the website without prior notice. Product prices are currently not subject to VAT, but its application will be indicated in the product description as soon as it applies.
5.1 Incorrect price
If there is any error in the price of the purchased product(s), Foraging Colours or the Client may cancel the order up until it is dispatched.
5.2 Total price
The total price specified at checkout includes taxes from the country of origin (Portugal), if applicable, and shipping costs. The Client must pay the full amount upon receiving the order confirmation email.
5.3 Foreign bank accounts
All purchase orders are processed in euros (€). If the Client's bank account is in another currency, the exchange rate applied for debiting the account will be determined automatically by the bank and not by Foraging Colours.
5.4 VAT
The prices of products and services displayed on the foragingcolours.com website do not include Value Added Tax (VAT) at this time.
5.5 Customs costs
Any customs costs related to the delivery country of the order will be borne by the Client.
6. Payment Methods
The Client may pay for their purchase using the Multibanco Reference payment system (for payments within Portugal) or via a PayPal account. Foraging Colours does not accept any other form of payment. The Client must not attempt to make payment through methods other than those described above; if they do, Foraging Colours cannot be held liable for any resulting damages.
7. Shipping Costs
Shipping costs are included in the total order amount. It is the Client's full responsibility to choose the shipping category, being aware of its cost at this stage.
7.1 Shipments to European Union countries
Shipments are made only to Portugal and the following European Union countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Romania, Slovakia, Slovenia, Spain, and Sweden.
7.2 Shipping Exceptions
Andorra (Spain); Büsingen (Germany); Canary Islands (Spain); Ceuta (Spain); Heligoland (Germany); Åland Islands (Finland); Faroe Islands (Denmark); Lake Lugano (Italy); Livigno (Italy); Melilla (Spain); Mount Athos (Greece). These exceptions apply due to non-compliance with EU legal bases.
8. Delivery
Foraging Colours processes orders from Monday to Friday, with dispatch occurring within a maximum of 24 working hours after payment confirmation.
If, during the processing of the order, any product is found to be unavailable, Foraging Colours will inform the Client, offering resolution options – a refund or replacement with another product of the same value.
8.1 In-person delivery
In-person delivery of the order is only possible in Parque das Nações, Lisbon, Portugal. To arrange this, the Client must select this option and, after payment, send an email with three suggested dates and times for Foraging Colours to choose from, including the order number. A date and time will be scheduled after payment confirmation.
8.2 Delivery to the Shipping Address
If the courier is unable to complete delivery to the shipping address, a second delivery attempt will be made after telephone contact. If delivery is still not possible (after two attempts), the courier will leave a notice for the Client, indicating that the order must be collected from a local store. The order must be collected within 3–4 days; otherwise, it will be returned to Foraging Colours.
It is the Client's responsibility, at the time of delivery, to check whether the packaging shows any damage or signs of being opened. If any such indication is observed, the Client should not accept the order, which will then be returned to Foraging Colours. The situation must be reported via foragingcolours@gmail.com, describing the issue and attaching photographs. Upon receipt of the returned order, Foraging Colours will cancel and refund the purchase.
8.3 Completion of Delivery
Delivery will be considered complete from the moment the Client signs the invoice provided by the courier.
9. Order Cancellation and Returns
Foraging Colours reserves the right not to accept and to cancel orders in the following situations:
- If the product is unavailable;
- When payment is not made using any of the payment options available on foragingcolours.com;
- If billing, contact, or shipping information is incorrect;
- If there is an error in the pricing;
- If the order could not be delivered after two delivery attempts.
9.1 Cancellation Due to Non-Payment
If the Client has not made payment, the cancellation will be considered automatic 48 hours after the date and time of the purchase order.
9.2 Cancelling Orders Before Dispatch
If the Client wishes to cancel the purchase order before dispatch, they must request the cancellation via email at foragingcolours@gmail.com within 24 hours of payment, indicating the order number. Cancelled orders will be fully refunded, including shipping costs, as the order has not been dispatched. This refund will be made by bank transfer to the Client. If the Client only wishes to cancel one of the items in the order, they must inform us of this by email.
9.3 Cancelling Orders After Dispatch
If a cancellation request is made after the order has been dispatched, the Right of Withdrawal (Section 11) will apply. Foraging Colours does not cover the costs associated with exchanges or returns due to reasons attributable to the Client.
10. Defects and Non-Conformities
Foraging Colours considers products to be defective or non-compliant if they present physical damage, manufacturing irregularities, or do not match the described product characteristics. Minor variations in colour or texture resulting from the artisanal production process are not considered defects or non-compliances.
If the Client receives a defective or non-conforming product, they may choose either to have the product replaced or to terminate the contract. The Client must report the issue as soon as it is detected, preferably within a maximum of 30 days after receiving the product, by emailing foragingcolours@gmail.com with a brief description and attaching supporting images.
After review, the brand will contact the Client to proceed with either the product replacement or a refund of the amount paid.
The purchased goods are covered by a legal conformity warranty of 3 years, under Decree-Law No. 84/2021, applicable to consumers.
10.2 Handcrafted Products and Natural Pigments
Each product is unique and handcrafted, so minor variations in colour, texture, or shape may occur. These are part of the charm of the products and are not considered defects.
11. Right of Withdrawal – Return Terms
The Client may exercise their right of withdrawal within 14 days of receiving the order. To do so, the Client must communicate their intention by email to foragingcolours@gmail.com and place the item(s) in properly sealed packaging for return.
The product(s) must be returned complete, with all accessories and original packaging materials. The Client may handle the product only to the extent necessary to verify its nature, characteristics, and functioning, as they could in a physical store. If the product shows signs of use, Foraging Colours may deduct the corresponding depreciation value from the refund.
The return shipping costs are the responsibility of the Client. The shipping costs of the initial order are non-refundable, except in cases of defects or shipping errors.
Foraging Colours will issue the refund within a maximum of 14 days after receiving the returned products, using the same payment method, unless otherwise agreed.
The right of withdrawal does not apply to personalised products, perishable goods, or products that, for hygiene or health protection reasons, cannot be returned once opened after delivery.
